Privacy and disclosures

Your information is not the product.

This policy explains what we collect when you apply, what we do with it, who receives it, and what you can ask us to do about it. It is written to be read, not to be survived.

Review status. This policy describes our actual practices as of the date above and is in effect. It has not yet completed outside legal review. If counsel's review changes anything material, we will update this page and move the date above.

Who we are

ONE APOLLO Capital is a financing referral service operated by ONE APOLLO, based in Santa Ana, California. We are a broker. We arrange financing through third party funding sources. We are not a direct lender, we do not make credit decisions, and we do not guarantee funding.

We are compensated by the funding provider when your deal funds, not by you. That compensation is part of the cost of the financing. We disclose it so you understand our role and our incentive. You are shown the full terms of any offer, including the total cost, before you sign anything.

What we collect

Information you give us. When you apply, we collect information about your business and its owners: legal and trade name, EIN, business and home address, time in business, industry, revenue, existing financing obligations, and the amount and purpose of the funding you are seeking. For each owner we collect name, email address, phone number, date of birth, ownership percentage, and Social Security number. You also upload business bank statements and, depending on the funder, other supporting documents.

Information we collect automatically. When you use the site we collect your IP address, browser and device information, pages viewed, and how you moved through the application. If you arrived from an ad or a link we recorded, we also store the advertising click identifier and campaign tags carried in that link, along with the referring website and the page you landed on. This is stored in your browser and attached to your application when you submit it, so we can tell which marketing actually produces funded businesses.

Information from other sources. With your authorization we obtain a soft credit report on the owner who signs the application. We do not obtain a credit report on any other owner listed on your application unless that person separately authorizes it. We may also receive information about your business from the funders we submit your file to, from public and commercial business databases, and from public filing records.

How we use it

  • To evaluate your request and estimate what you may qualify for.
  • To match your file against the underwriting criteria of the funders in our network.
  • To submit your file to funders whose underwriting criteria fit it.
  • To contact you about your application and the offers it produces.
  • To verify identity, prevent fraud, and meet our legal and recordkeeping obligations.
  • To measure which marketing channels produce real funded businesses, and to operate, secure, and improve the site.

We do not use your information to market unrelated products to you, and we do not build a profile of you for anyone else's benefit.

Automated matching and human review

We use automated systems to read the information and documents you provide and to match your business profile against the criteria of the funders in our network. Those systems decide which funders are a fit for your file. They do not decide whether you get funded. People at ONE APOLLO Capital review and verify the file before it is submitted, and every funding decision is made by the funder after its own underwriting. If you want a person to explain how your file was matched, ask us and we will walk you through it.

Who we share it with

Funders in our network. You direct us to do this when you apply. The entire purpose of your application is to have us put your file in front of funders who might finance it, so submitting it is us carrying out your request, not us circulating your details. We share what is necessary to evaluate that request, with the funders your file actually fits, not with everyone. Once a funder receives your file, its handling of your information is governed by its own privacy practices, which we do not control. A funder may contact you about the offer it is making.

Service providers. Companies that operate our systems, including hosting, document storage, email and telephony, identity verification, and credit reporting. They act on our instructions and are not permitted to use your information for their own marketing.

Advertising and analytics platforms. See cookies, analytics, and session replay and advertising and measurement below, which describe exactly what those platforms receive.

Legal and safety. When required by law, subpoena, or regulator, or to investigate fraud, protect our rights, or protect someone's safety.

Corporate transactions. If ONE APOLLO Capital is involved in a merger, acquisition, or sale of assets, your information may transfer as part of that transaction. We would tell you before it became subject to a different policy.

What we never do

We do not sell, rent, or trade your contact information to lead buyers, marketing companies, or other brokers. Applying here does not put your phone number or email address into circulation. This is the entire reason the company is built the way it is.

We hold your phone number back. We do not release it to a funder while your file is being underwritten. Verification calls a funder would otherwise make to you come to us instead. Your number reaches the funder when your deal funds and that funder becomes the company you are actually doing business with.

We also do not run a hard credit inquiry without your separate authorization, and we do not submit your file to funders whose underwriting does not fit it.

One thing we cannot control. When a deal funds, the funder files a UCC-1 financing statement, which is a public record. Companies that build calling lists harvest those filings and attach a phone number from other sources. That window is open to every borrower in this industry and nobody, including us, can close it. We would rather tell you now than have you find out.

Credit inquiries

Checking your options uses a soft credit inquiry, which does not affect your credit score. You authorize that inquiry when you submit your application. A hard inquiry happens only if you choose to proceed with a specific funder and separately authorize it at that point.

Because most business financing we arrange involves a personal guarantee, the credit report we obtain is a report on the owner as an individual. If financing is declined on the basis of information in a consumer report, you are entitled to be told which reporting agency supplied it, and the funder that made the decision is responsible for that notice.

Cookies, analytics, and session replay

Nothing measures you until you say yes. Session replay does not load at all unless you accept analytics, so no recording of your visit exists before you consent. The Google tag does load, but in a denied state: it sets no cookies and sends no analytics or advertising data unless and until you accept. Cookies strictly necessary to make the site work are always on. You can change or withdraw your choice at any time using cookie preferences.

When you consent, we use:

  • Google Analytics 4, to understand how the site is used in aggregate.
  • Google Ads tags, to measure which ads lead to applications.
  • Microsoft Clarity, which records heatmaps and session replays of your visit so we can see where the application is confusing and fix it.

About session replay. Microsoft Clarity reconstructs a visual playback of your visit. It does not run on the application at all. The pages where you enter your Social Security number, your financial details, and your documents are excluded from session replay outright, so no recording of your application exists, whatever you chose in the banner. On the rest of the site, replay only runs if you accepted analytics, and anything typed into a form is masked in your browser before it is sent.

Advertising and measurement

We advertise on platforms including Google and Meta, and we need to know which of those ads produce real funded businesses rather than just form fills. To measure that, we record the advertising click identifier that brought you to the site, and we may report back to the advertising platform that a funded deal resulted from a click it delivered, together with the value of that deal.

Where that report includes information that identifies you, such as your email address or phone number, it is cryptographically hashed before it is sent, so the platform can match it to an account it already has without receiving readable contact details from us. We do not send your Social Security number, your bank statements, your financial details, or your funding terms to any advertising platform, ever.

You can stop this. We only record the click identifier if you accept advertising in our cookie preferences. If you decline, we do not record it, and if one was recorded on this device earlier we delete it. A Global Privacy Control signal from your browser has the same effect automatically, with nothing for you to click, and it cannot be overridden.

Calls, texts, and recorded lines

By submitting an application you consent to be contacted about that application by phone, text message, and email at the numbers and addresses you gave us. Consent to be contacted is not a condition of obtaining financing. Message and data rates may apply. Reply STOP to any text to stop texts, and tell us in any channel to stop calls.

We contact you the way you tell us to. If you ask us not to call, we do not call. You can change your contact preference at any time by replying to any message from us or by emailing the address below.

Recorded and AI-assisted calls. Calls to and from our published numbers may be recorded, transcribed, and summarized for quality, training, and record keeping. Our published numbers are answered by an automated assistant with a synthetic voice that can take your details and route you to a person. It answers incoming calls only. We do not use it to place outbound calls to you. If you would rather not be recorded, tell us and we will stop, or end the call and email us instead, and you can ask for a person at any point.

Text messaging program

ONE APOLLO Capital sends text messages about your application and funding file: status updates, document requests, and replies to questions you send us. You opt in by submitting an application or otherwise giving us your mobile number and agreeing to be texted. Consent to receive text messages is not a condition of obtaining financing. Message frequency varies. Message and data rates may apply. Reply STOP to any message to cancel, or HELP for help. Our terms of service carry the full text messaging terms.

No mobile information will be shared with third parties/affiliates for marketing/promotional purposes. All categories of information described in this policy exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

How we protect information

Your Social Security number is encrypted in transit and at rest, is held in a dedicated secrets vault separate from the rest of your application, is never sent in plain text by email, and is never displayed in our internal lists, exports, or reports. Access to it is limited to the people who need it, and every time it is viewed internally, that view is logged with who looked and when.

Documents you upload are stored in private storage that is not publicly reachable and are served only through authenticated internal access. We maintain administrative, technical, and physical safeguards appropriate to the sensitivity of this information. No system is perfectly secure, and we do not claim otherwise, but we do not cut corners on this category of data.

How long we keep it

We keep your application for as long as needed to provide the service and to meet our legal, tax, and recordkeeping obligations, and to resolve disputes. In practice that means applications and funding records are retained for several years after your last activity with us. Uploaded documents are kept only as long as they are needed for the file and the funder relationship it produced. Identifiers we hold to block fraudulent or abusive applicants are kept until we are satisfied the risk has passed, because deleting them would defeat their only purpose.

You can ask us to delete your information sooner. See below.

Your choices and rights

  • Access. Ask what we hold about you and get a copy.
  • Correction. Ask us to fix anything inaccurate.
  • Deletion. Ask us to delete your information, subject to records we are required to keep.
  • Contact preferences. Tell us to stop calling, texting, or emailing, in any channel, at any time.
  • Advertising and analytics. Open cookie preferences at any time to change or withdraw your choice, which stops the tools described above from loading and erases any advertising click identifier we hold for this device.
  • Withdraw consent. Withdraw the consent you gave when you applied, at any time, by contacting us.

To exercise any of these, email aja@oneapollocapital.com. We will verify your identity before acting on a request, because acting on an unverified request is itself a privacy failure. We do not charge for this and we do not treat you differently for asking.

California residents

California law gives residents specific rights over personal information, including the rights to know, delete, and correct described above, the right to know whether personal information is sold or shared for cross context behavioral advertising, and the right to opt out of that sharing.

We do not sell your personal information for money. We do treat the advertising measurement described in advertising and measurement as sharing under California law, because reporting a conversion back to an advertising platform is a disclosure for cross context behavioral advertising, and California counts that as sharing whether or not we are paid for it. We do not take the narrow reading. The categories involved are online identifiers and internet activity, and the recipients are advertising platforms. You can opt out at any time through cookie preferences, by sending a Global Privacy Control signal from your browser, which we honor automatically, or by emailing us. We never share your Social Security number, your bank statements, your financial details, or your funding terms with an advertising platform, and we do not sell or share the personal information of anyone we know to be under 16.

You may designate an authorized agent to make a request for you. We will still verify the request. California residents may also request the categories of personal information we disclosed for a business purpose in the preceding twelve months, which are the categories listed in what we collect, disclosed to the recipients listed in who we share it with.

Other terms

Business applicants. This site is for business financing. We do not offer consumer loans, and the financing we arrange is for business purposes only.

Children. This site is not directed to anyone under 18 and we do not knowingly collect information from children.

Other websites. Our site links to other companies, including funders and ONE APOLLO brands. We are not responsible for their privacy practices, and their pages are governed by their own policies.

Changes. If we change this policy we will update the effective date at the top of this page. If a change materially affects how we handle information you already gave us, we will tell you directly.

This is the control. It opens the same panel as the banner, it works whether or not you answered the banner before, and it is where you turn advertising off.
